How Does Delta-8 THC Work?
Much of the excitement around D8 is related to its effects that are closely related to THC. Users see D8 as a way to get the effects legally or without going to a dispensary. We view D8 as the most revolutionary cannabinoid today because of its ability to directly bind with CB2 receptors.
Both D8 and D9 have the affinity to bind with CB1 receptors in the brain and CB2 receptors throughout the body but are primarily located in the digestive system. Is Delta-8 Legal?
Cannabis laws in general are anything but clear. Delta-8 THC was made legal along with CBD and all other cannabinoids, excluding D9 THC, in the groundbreaking 2018 ‘Farm Bill.’ The bill clearly states that all cannabis products containing 0.3% D9 THC or less are federally legal. Because the ‘Farm Bill’ specifically states ‘Delta 9,’ meaning that all other cannabinoids are legal to trade and consume in the United States, including D8 THC.
The FDA recently revised their statements on the definition of hemp causing concern for users taking advantage of the benefits of D8. Their statement excludes all synthetically created cannabinoids from the protection of the ‘Farm Bill.’ Because Delta-8 THC can be created by modifying CBD isolate, many were concerned that the FDA was referring to D8. We are confident that the statements made by the FDA are regarding synthetic cannabinoids like ‘K2’ and ‘spice’ that aren’t derived from hemp. Synthetic CBD has also made an appearance in the legal USA market raising concerns about the manufacturing process.
We expect the FDA to comment directly on Delta-8 THC in the future, but for now, they 100% respect the regulations regarding hemp set in 2018 by the ‘Farm Bill.’
